גמרא ואמרינן מ"מ דר"י. הלשון קשה קצת דהא לקמן דף יד ע"א איתא בברייתא דר"י עצמו אמר כן:

שם אלא ה"ט דרבי. ק"ל דלמאי צריכין לטעמא דרבי אף למעלה ב' הא מפשוטו דמקרא דאשר ירשיעון והיינו ב' נדע דבעינן ג' מכח דאין ב"ד שקול וע"כ אידך קרא דאלהים אתא לרבוי' דהיינו ד' ואין ב"ד שקול הרי כאן חמשה:
